Forming an LLC is much easier than you may realize. You don't need an expensive attorney to complete forms that you can do yourself. After a short amount of time and a trip to the post office, you will be on your way to running a Limited Liability Company.
Create an operating agreement. Certain states will require you to file this document, but you should create one anyway. Plenty of free sample agreements are available on the Internet. Simply copy and paste it into your word processor and make the necessary changes. You will need to include members' ownership percentages, rights and responsibilities, profit and loss distribution, management, voting powers and buy-sell procedures.
Create and file the articles of organization. This a short form that contains information including the LLC name, address and member information. It will require a fee, determined by each state, that must be included with the form. You can easily get a copy of this form from the Secretary of State's website or office. Make a copy for your files, and mail it to your state. The state should stamp a file date on your form and mail you a return copy.
Establish the LLC name. Check with the Secretary of State's office in the state in which you are creating your LLC. Your name must be unique. There cannot be two LLCs with the same name. Your state may have additional rules on creating your LLC name.
