Leather exports form an essential part of the international trade today. It constitutes a good portion of the international trade. International trade today is growing at a great speed. It is being boosted by leather industry.
Any agreement which has its compliance with the International law can be referred as a TREATY. Different terms can also be used which are synonym with Treaty viz: - Agreement, Protocol, Covenant Convention, Exchange of Letter etc. Regardless of the names all of these refer to the same thing. In lay man terms treaty is equivalent to Contracts, both are means of willing parties assuming obligations among themselves, and a party to either that fails to live up to their obligations can be held liable under international law for that breach.
A three step questionnaire is designed to evaluate any treaty, following which amounts to the adaptation of the treaty.
The third step is the passing of implementing legislation through the national parliament.
Ratification:
'Ratification' is the final acceptance and agreement to implement.
Interpretation of any treaty means careful examination of the legal jargons and the conditions prevailing in the treaty. This needs thorough understanding of the nature of the treaty and interpretation in good faith, which should be done in context of the object and purpose of the treaty. 'Principle of maximum effectiveness' is often applied by legal experts to interpret treaties so that they have the thorough understanding of the obligations of the treaty from its words as having the fullest force and effect possible.
Signing:
'Signing' an international treaty is an indication of willingness to adopt.
Unless specified in the treaty, no party of the treaty can impose any interpretation of its own. In these conditions "Consent" plays a vital role. Consent by all parties to the treaty to a particular interpretation has the legal effect of adding an additional clause to the treaty - this is commonly called an authentic interpretation.
